FMC has sought, and won, a preliminary injunction against a rival selling generic agrochemicals. At issue was the label that was submitted to the EPA. FMC claimed, and the judge agreed, that CSI had improperly copied the TalstarOne label (bifenthrin) in violation of FMC's copyrights in that label. A preliminary injunction was issued against further use of the CSI label by CSI with the requirement that CSI notify its distributors, customers, and sub-registrants" of the injunction. CSI has appealed the Order but must now re-work its label and seek EPA approval for the revised label. The trick will be to see how fast CSI can get a new label.
